Clear terms, a real guarantee, and support that answers.

These are the terms for using Ekas. We have written them to be read, and we have put the parts that matter most — the Approval Guarantee, how setup and custom work are priced, and our support service levels — where you can find them.
01Agreement to these terms
These Terms of Service (the “Terms”) are a contract between you and Ekas (“Ekas,” “we,” “our,” or “us”) and govern your access to and use of our website, platform, API, MCP, widget, hosted flows, and related services (together, the “Services”). By creating an account or using the Services, you agree to these Terms. If you are agreeing on behalf of a company, you represent that you are authorized to bind it.
These Terms include our Approval Guarantee and our support service levels. Please read them.
02Definitions
- “Customer Data” — data you submit to the Services or that we process on your behalf, including information about your own customers and end users.
- “Provider” — a messaging or CPaaS provider you use to send messages and file registrations, such as Twilio, Telnyx, Bandwidth, Sinch, or Plivo.
- “Registry / Carrier” — the bodies that adjudicate registrations, including The Campaign Registry (TCR), the toll-free ecosystem, Google’s RCS ecosystem, and the mobile carriers.
- “Registration” — a 10DLC brand or campaign, an RCS agent or brand, or a toll-free verification you file through or with help from the Services.
- “Registration Fee” — the one-time, non-refundable fees a Provider, Registry, or Carrier charges to register and vet a Registration, and that are consumed when a submission is rejected. Defined in detail in the Approval Guarantee.
- “Cleared” — a Registration that the Services have marked as compliant and ready to submit.
03The Services
Ekas helps you get messaging Registrations approved. We check a Registration against current carrier and registry rules, tell you what will likely cause a rejection, help you fix it, and help you file — across 10DLC, RCS, and toll-free, delivered through our product, API, MCP, embeddable widget, and hosted flows.
Ekas is a compliance layer that sits on top of your Provider. We are independent and not affiliated with, endorsed by, or acting for Twilio, Telnyx, Bandwidth, Sinch, Plivo, TCR, Google, or any carrier. You keep your own accounts and relationships with your Provider and the Registries, and their terms and fees apply to you directly.
04Accounts and eligibility
The Services are for business use. To use them you must register for an account, provide accurate information, and keep it current. You are responsible for your account credentials and for all activity under your account, and you agree to notify us promptly of any unauthorized use.
05Acceptable use
You agree not to:
- Use the Services to submit false, misleading, or fraudulent Registration information.
- Use the Services to enable messaging that is illegal, or that violates carrier or registry rules — including unlawful SHAFT content, phishing, or messaging without proper consent.
- Reverse engineer, resell, or misuse the Services, or attempt to access another tenant’s data.
- Interfere with or place unreasonable load on the Services, or bypass usage limits.
We may suspend access for a material or repeated breach, or where required to protect the Services or comply with law.
06Setup, implementation, and custom work
Getting live should not be a paid add-on. Standard onboarding, integration help, and implementation support for the Services — including our API, MCP, widget, and hosted flows — are included with your subscription at no extra cost. Ask us and we will help you get set up.
Custom work
We also take on custom requests — bespoke integrations, non-standard workflows, enterprise-specific builds, data migrations, and similar work that goes beyond standard setup. Custom work is scoped and priced separately from your subscription, and is agreed in a written statement of work or order before it begins. You are never charged for custom work you have not approved in writing.
07The Approval Guarantee
We stand behind our compliance calls. If we Clear a Registration and it is still rejected, we cover the Registration Fee. Here is exactly how it works.
The guarantee
If (1) Ekas Cleared your Registration as compliant, (2) you submitted exactly the data we Cleared, without changes, and (3) the Registration was still rejected by the Provider, Registry, or Carrier for a compliance reason within our scope, then we will refund the Registration Fee for that submission, and the rejection will not count against any approval quota on your plan.
How the refund is paid
Eligible refunds accrue as you incur them over your billing month and are applied as an account credit on that month’s statement. Credits offset your Ekas charges; they are not paid out as cash. To process a refund we need proof of the Registration Fee you were charged and the rejection notice, submitted within 30 days of the rejection.
What counts as a Registration Fee
Registration Fees are set by the registries and their vetting partners — The Campaign Registry and Aegis — not by Ekas, and they change from time to time. Providers such as Twilio, Telnyx, Plivo, Vonage, and Bird pass them through at or near the registry’s rate; some, such as Bandwidth, re-bill them at a markup, and your Sinch rate is set in your Sinch account. The binding amount is always the fee you actually paid your provider for the rejected submission we Cleared. The tables below show the typical pass-through fees as of July 2026 and, for each, whether it is refundable (a fee is refundable only if the rejection actually consumed it).

RCS fees depend on your registration path — the registry’s Aegis “RCS Vet” or your provider’s own verification scheme — so amounts vary. Google’s own agent verification and carrier launch approval are free. Your provider’s current schedule controls.
Toll-free (TFN)
Toll-free verification is free at every major Provider, so there is no Registration Fee to refund. The guarantee still applies in kind: if we Cleared a toll-free verification and it is rejected, we re-work and re-submit it at no cost to you, and it does not count against your quota.
What the guarantee does not cover
- Submissions where you changed, added to, or omitted any of the data we Cleared.
- Registrations based on information you gave us that was inaccurate, incomplete, or misrepresented.
- Rejections for reasons outside registration compliance — for example prohibited or unlawful content, fraud, or brand-identity issues you introduced.
- Rejections caused by a Provider, Registry, or Carrier rule that changed after we Cleared the Registration. We will re-work these under support, but the changed-rule fee is not refundable.
- Fees a Provider or Registry itself refunds or waives, or fees for a Registration that remains usable (no double recovery).
- Carrier RCS activation fees (for example T-Mobile’s, up to ~$500) — a large, carrier-set launch charge outside our compliance scope, and not refundable.
- Toll-free verification, which is free (covered in kind, as above).
This guarantee is your sole and exclusive remedy for a rejected Registration, and the total credit for any submission is capped at the Registration Fee actually paid for it.
08Fees, billing, and credits
You agree to pay the fees for your plan. Unless stated otherwise, subscription fees are billed in advance and usage fees in arrears, and fees are exclusive of taxes, which you are responsible for. Approval-Guarantee credits and any other credits are applied on your monthly statement and reduce amounts you owe; they have no cash value and expire on account termination.
We may change our prices on renewal or with reasonable notice. Registration Fees and other amounts charged by your Provider or the Registries are separate from Ekas fees and are payable by you directly to them.
09Support and service levels
Support is included with the Services. Reach us at hello@ekas.io or through in-product support, and we will respond within these targets:
Support SLA
- Acknowledgment within 2 business days. We confirm we have received your request and have a person on it.
- Mitigation within 7 business days. We provide a fix, a workaround, or a clear path to resolution for the issue.
These targets are measured in business days from when we receive a complete request, and we use commercially reasonable efforts to meet them. Some outcomes depend on a Provider, Registry, or Carrier whose timelines we do not control; where that is the cause, we keep you updated and press it on your behalf. The support SLA is a response commitment and is not a guarantee of Service uptime.
10Customer Data, privacy, and security
You own your Customer Data. You grant us a limited license to process it only to provide, secure, and support the Services for you. How we handle it is set out in our Privacy Policy, and in short:
- Separated by tenant — Customer Data is logically segregated per account and access is scoped to your tenant.
- Never sold — we do not sell, rent, or trade Customer Data.
- Never used to train models — we do not use Customer Data to train or fine-tune any AI model, ours or a third party’s.
- Deleted on request — we delete Customer Data on request and on termination, as described in the Privacy Policy.
You are responsible for having the rights and consents needed for the Customer Data you submit, including any personal information about your end users.
11Third-party providers, registries, and carriers
The Services help you work with Providers, Registries, and Carriers, but we do not control them. Their reviews, decisions, timelines, policies, and fees are their own, and approval of any Registration is ultimately theirs to grant or deny. Except as expressly set out in the Approval Guarantee, Ekas is not responsible for their decisions or charges. Your use of their services is governed by your agreements with them.
12Intellectual property
The Services, including our software, models, content, and brand, are owned by Ekas and our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services during your term. You keep all rights in your Customer Data, and you may give us feedback, which we may use without obligation to you.
13Confidentiality
Each party may receive confidential information from the other. The receiving party will use it only to perform under these Terms, protect it with reasonable care, and not disclose it except to people who need it and are bound by similar obligations. This does not apply to information that is public, independently developed, or lawfully received from another source, or where disclosure is legally required.
14Disclaimers
Ekas provides compliance tooling and guidance, not legal advice. Our checks and recommendations help you get approved, but you are responsible for your messaging program and its compliance with law and carrier rules.
Except for the express commitments in these Terms — including the Approval Guarantee and the support SLA — the Services are provided “as is” and “as available,” and we disclaim all other warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any Registration will be approved, since that decision rests with the Registries and Carriers.
15Limitation of liability
To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Except for your payment obligations and each party’s indemnification obligations, each party’s total liability arising out of or relating to these Terms will not exceed the amounts you paid Ekas for the Services in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
16Indemnification
You will defend and indemnify Ekas against third-party claims arising from your Customer Data, your messaging program, or your breach of these Terms or of applicable law. We will defend and indemnify you against third-party claims that the Services, as provided by us, infringe that third party’s intellectual-property rights. The party seeking indemnity must give prompt notice and reasonable cooperation.
17Term and termination
These Terms apply while you use the Services. Either party may terminate as set out in your plan or for material breach that is not cured within a reasonable period. On termination, your right to use the Services ends, we delete Customer Data as described in the Privacy Policy, and any outstanding fees become due. Terms that by their nature should survive — including fees owed, confidentiality, IP, disclaimers, and limits of liability — survive termination.
18Changes to the Services and these terms
We may update the Services and these Terms from time to time. For material changes to the Terms, we will update the “Last updated” date above and provide reasonable notice. If you keep using the Services after a change takes effect, you accept the updated Terms. If you do not agree, stop using the Services.
19Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The parties will first try to resolve any dispute informally by contacting hello@ekas.io. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, unless the parties agree otherwise in writing.
